Terms of Use

These Terms govern your use of the MEHMBR mobile application. By creating an account, you agree to them. If you do not agree, do not use MEHMBR.

1. Who you are contracting with

MEHMBR is operated by Abhimanyu Kapoor Saraya, a sole proprietor trading as

Kapsar, GSTIN 06IMHPK0555F1Z3, principal place of business TG4 1B, Tower TG4, C/D Block Road, Sector 54, Gurugram, Haryana 122011, India.

2. What MEHMBR is — and what it is not

MEHMBR is a platform that lets you discover wellness studios ("Studios"), view the classes, private sessions and memberships they offer, and make bookings.

MEHMBR is an intermediary. We do not provide any class, session, training or wellness service. Every class listed on MEHMBR is provided by an independent Studio. Your contract for any class, credit package or membership is with that Studio, not with MEHMBR.

MEHMBR's role is to display Studio listings, record your credit and membership balances, and manage bookings.

3. Eligibility

You must be 18 years of age or older to use MEHMBR. By creating an account you confirm that you are. We do not permit accounts for people under 18.

You must provide accurate information and keep it up to date. You are responsible for everything done through your account. Do not share your account with anyone else.

4. Your account

You sign in using your email address and a password. Keep your password and your email account secure. Tell us immediately at support@mehmbr.com if you believe someone else has accessed your account.

We may suspend or terminate your account if you breach these Terms, if we reasonably suspect fraud or abuse, or if required by law. Where we can, we will tell you why and give you a chance to respond.

5. Credits and memberships

5.1 What they are

Credits are a prepaid balance you hold with a specific Studio, which you spend on that Studio's classes. Memberships are a package of sessions you hold with a specific Studio.

Credits and memberships are Studio-specific. Credits bought from one Studio cannot be used at another. They are not a general-purpose balance, not transferable between Studios, and not redeemable for cash by MEHMBR.

5.2 Buying them

You request credits or a membership through the app. You pay the Studio directly. Once the Studio confirms payment, it grants the credits or membership, and your balance in the app updates.

MEHMBR does not receive your money and does not issue any receipt or invoice for it. Your receipt comes from the Studio. Any question about a charge, including a disputed or failed payment, must be raised with the Studio.

5.3 Expiry

Credits and memberships have a validity period set by the Studio (by default, 12 months from purchase). The validity is shown when you buy, and the expiry date is shown in your wallet. After it passes, unused credits or sessions expire.

5.4 Refunds in money

MEHMBR does not issue monetary refunds, because MEHMBR never receives your money. If you want money back for unused credits or an unused membership, you must ask the Studio directly, and it is for the Studio to decide in line with its own refund policy and applicable law.

5.5 If a Studio leaves the platform

A Studio may stop using MEHMBR, be suspended, or cease trading while you still hold credits or membership sessions with it.

In that situation your credits and membership remain a claim against that Studio, not against MEHMBR. You paid the Studio, the Studio holds your money, and the Studio owes you the service. We will, on request and where we hold it, give you the Studio's contact details and a record of your balance and transaction history to help you pursue your claim.

We will make reasonable efforts to notify you before removing a Studio from the platform where we know users hold balances with it, but we cannot guarantee notice where a Studio ceases trading without informing us.

6. Bookings and cancellations

When you book a class, you spend credits or a membership session. A booking is confirmed only when the app shows it as confirmed.

Cancellation windows and refund rules are set by each Studio and shown on the class before you book. If you cancel within the Studio's window, your credits or session are returned to your balance automatically. If you cancel outside it, they are not.

If a Studio cancels a class, your credits or membership session are returned to your balance in full.

MEHMBR does not guarantee that any class will take place, that any instructor will be available, or that a Studio's listing is accurate.

7. Health, fitness and your own safety

Physical exercise carries risk of injury. By booking a class you confirm that you are medically fit to take part.

MEHMBR does not screen, assess or verify your fitness to exercise, and does not employ, supervise or train any instructor. Consult a qualified medical practitioner before starting any exercise programme, particularly if you have an existing condition, are pregnant, or are recovering from injury.

Tell the Studio about any condition, injury or limitation before your class. Stop immediately and seek help if you feel unwell.

8. Reviews and content you post

You may post reviews and ratings of Studios you have attended. You must:

You keep ownership of what you post, and grant us a non-exclusive, royalty-free licence to display, store and distribute it on the platform.

We may remove content that breaches these Terms or our Community Guidelines. We do not routinely pre-screen content, and we are not responsible for the views expressed in user reviews.

10. Intellectual property

The MEHMBR name, logo, app design, and all software are owned by Kapsar. Studio names, logos, images and descriptions belong to the respective Studios. Nothing in these Terms transfers any intellectual property to you.

11. Availability

We aim to keep MEHMBR available but do not guarantee uninterrupted service. We may suspend the platform for maintenance, upgrades or reasons beyond our control. We may change, add or remove features.

12. Our liability

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.

Subject to that:

cancelled classes, poor service, injury, or refusal to refund

revenue or opportunity

limited to the total commission we actually received in respect of your transactions in the 12 months before the claim arose

Because MEHMBR does not receive payment for classes, credits or memberships, any claim for the value of a class, credit or membership lies against the Studio.

13. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the platform, or content you post.

We acknowledge complaints within 48 hours and resolve them within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020. For complaints about content or personal data, we acknowledge within 24 hours and resolve within 15 days, in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Complaints about a class, a Studio's service, a payment or a refund should be raised with the Studio first, since your contract is with them. If you cannot resolve it, tell us and we will help where we reasonably can.

15. Changes to these Terms

We may update these Terms. Material changes will be notified in the app before they take effect. Continuing to use MEHMBR after that means you accept the updated Terms. If you do not accept them, delete your account.

16. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Gurugram, Haryana have exclusive jurisdiction, save that nothing prevents you from approaching a consumer forum with jurisdiction over your place of residence under the Consumer Protection Act, 2019.
